Transparency and Private Investigators....

In the spirit of "Transparency" , Pat McMahon requested the Private Investigator's report regarding the Clearlake vs LSCO Narcotics Task Force stand off. 

Things to remember:
1.  This investigation was conducted by private company(ies) using taxpayer money.
2.  It involves not only officer saftey, but public safety issues.
3.  Rivero ran on a campaign of "Transparency".
4.  The California Public Records Act is very specific about what reasons can be used to deny a request.
5. According to the above referenced, California Public Records Act, the county only has 2 weeks to comply with a request.

His request was denied by Anita Grant, Lake County Counsel.  What reason did she give?  She said,



"As to your request for any reports and/or documents prepared by California Judicial Investigations, please be advised that presently no final document exists; there is only a draft document which is not in the custody, possession, or control of Sheriff Rivero, but in mine."


Here is Pat's reply, explaining why her arguement fails to hold water...


So here are the questions we, as citizens, are left with.

A.  Why doesn't Frank have a copy of a report that HE ordered?
B.   Why doesn't County Counself want it released? 
C.  How much did be pay for this "report" so that it's results could be hidden from us?
D.  Where is the "Transparency" ?

  1. I have had this battle with a crooked DA in Yolo County named Jeff Reisig. County Counsel works to protect the department heads, in fact county counsel represents the Department heads as their lawyer so they will benefit from attorney client privilege, that way even when county counsel finds or discovers evidence that shows the Department head wrong, they can legally conceal it under the ruse of Attorney Client privilege. It is the biggest scam and waste of tax payer money, yet it is done in all counties.

    The Board of Supervisor could step in and help, but they won't since their lawyer is the same lawyer that represents the Sheriff.

    Until you actually fight the US Gov, you can't appreciate the full meaning of "the full power of the Govt."

    Unless the people join up and say enough is enough they will just hide, conceal and put out false and misleading press releases to confuse the public, knowing people will get tired and forget it or move on.

    The Grand Jury could step in and do their own investigation and they can release it to the public, but they won't unless enough people demand it.

    I would suggest that everyone write and file a complaint with the Grand Jury requesting this and that way anyone can show up and give information. However, if the DA is on the side of the Sheriff, which they normally are since they both want each others endorsement, then the DA can influence the Grand Jury and lead it in the direction he wants.

    Lots of insider protection for the system and those in it.
